Frequently Asked Questions

Estate Planning

Not at all. Estate planning is for anyone who wants to ensure their family is protected and their wishes are respected.

If you need updates to your existing document, we can help you create new documents and/or restate (update) your existing trust document(s). You can schedule an appointment here to get start and select single or family will, or trust based on your existing document(s).

Yes. While our process serves most families, there are certain situations that may require the expertise of a local estate planning attorney. If you answer “yes” to any of the following, we recommend seeking direct legal support:

  • Is your estate near or above the federal estate tax exemption amount (≥$13.61M/person)?
  • Are you planning to disinherit a child?
  • Do you have concerns about mental capacity (for yourself or someone involved)?
  • Are you worried about undue influence or pressure from someone else?
  • Is there a history of family litigation around estates or trusts?
  • Are you planning to leave a significant gift to a non-family caregiver?

In these cases, working directly with an attorney will ensure your plan is as strong, fair, and enforceable as possible.

Once draft documents are submitted for review, completed documents are typically received in about 7 business days. From there, we will schedule your signing session to execute your documents.

Absolutely. Encorestate requires a rush fee of $200 for next day delivery (if submitted by 5 p.m. Pacific Time) or $100 to have guaranteed 3 business day delivery. Depending on the circumstance, you may need to schedule an external company to conduct the notarization to execute the forms.
